现阶段我国征地补偿价格标准研究

摘要:
现阶段我国的征地补偿机制存在补偿额度过低、补偿范围不明确、土地新增收益的归属不清晰等问题。文章以土地二元价值理论为基础,结合马克思的地租与地价理论及科斯定理,旨在提出自己关于征地补偿价格标准改善的可行性建议。该文将不动产估价中的市场比较法与收益法引入征地补偿机制中,提出以下建议:(1)集体与失地农民分开补偿,对于有相关权益的土地的损失也应纳入补偿的范围。(2)市场机制与政府作用相结合进行补偿,其中政府以市场机制为基础在补偿过程中起主导作用。对集体的补偿以当前市价为基准进行补偿,可由市场比较法确定,对失地农民的补偿借鉴不动产估价的收益法,通过其净收益除于以当期活期存款利率为基础而确定的资本化率进行补偿。(3)政府应不断提高自身的行政素养与专业能力,完善其执行与监督机制。(4)完善地籍管理工作,促进产权明晰。(5)新增收益应明确其来源问题,应归作产生新增收益投资行为的投资者。

STUDY ON THE LAND ACQUISITION COMPENSATION STANDARD IN CHINA

Abstract:
Nowadays there are several problems in the compensation of the land acquisition such as the low compensationprice, unclear scope of compensation, and uncertain attribution of the benefits of land. This paper aimed to put forward some suggestions toimprove the land acquisition compensation standard on the basis of the view of land dualistic value, using the Marx land rent and price theory and Coase's theorem. And also it introduced the market comparisonand income approach into the compensation mechanism. It suggested that (1) the compensation for farmers and communities should be separated. The loss of adjacent land also should be included in the scope of compensation.(2)The compensation for communities should be decided according to the market priceusing market comparison approach, while the compensation for farmers should use the income approach on the basis of the capitalization of the net income which was decided by the income deposit interest rate. (3)the supervisory administration should improving the implement and monitoring system. (4)improving the land management and promoting the property rights more clearly. (5)Definitely decide the new benefits of landinto the investors.
