农村土地制度改革背景下宅基地使用权申请取得制度的改革与完善

摘要:

农村村民依法向当地集体经济组织申请取得宅基地使用权才能合法使用宅基地，宅基地使用权申请取得制度的改革与完善是宅基地制度改革与完善的前提与基础。理论界与学术界对宅基地使用权取得予以高度重视，但主要观点散见于用地标准、“一户一宅”等方面论述中，鲜有系统的、全面的关于宅基地使用权取得制度改革与完善的论述。文章对宅基地使用权申请取得的概念进行了剖析，阐述了十七届三中全会以来农村土地及宅基地制度政策的演变。从申请取得资格的认定、申请原则与面积标准、审批与监管等方面对存在的问题进行了分析。在总结宅基地取得制度研究的基础上，结合当前深化农村土地制度改革的实际，从明确集体经济组织成员资格的认定标准、合理认定申请取得资格，完善申请取得原则与面积标准，严格申请取得的审批、加强监管等方面提出改革与完善的建议，以期为当前我国农村土地制度的改革提供一些参考，进而为我国深化改革与农村经济与社会发展做出贡献。

Abstract:

Villagers can obtain the right to use their housing sites only after applying to the collective economic organizationsThe reform and improvement of the applying system of housing sites are the preconditions and foundation of the improvement of the housing sitesThe theoretical and academic circles attached great importance to the right of the use of the housing sites，but the ideas only cover the standard of land use，one household one dwelling，and so on，which lack systematic and comprehensive statement on the reform and improvement of the applying and obtaining system of housing sitesThis paper analyzed the concept of the applying and obtaining system of housing sites，illustrated the evolution of the policies of the land and housing sites reforms in rural areas since the Seventeen of the Third Plenary Session of the CPC，and discussed the problems in the qualification of applying and obtaining，applying principles and area standards，and approval and supervision，etc.Based on the studies of the obtaining of housing sites and combined with the practice of deepening reform of the land system in rural areas，this paper put forward some suggestions on the reform and improvement from clarifying the identification standard of membership of the collective economic organization，certificating the qualification of applying and obtaining，improving the principles and standards and strengthening the approval and supervision of applying and obtainingIt can provide some references on the reform of land system in rural areas and make contributions to the reform，the rural economy and the development of the society.
