成都市农地流转中的土地发展权配置实证研究

摘要:
[目的]农地流转是城市化发展的必然结果,土地发展权的合理配置有利于实现土地流转的最大利益,同时为我国土地管理制度和保护土地流转过程中农民权益提供一定的指导。[方法]文章以成都市为研究对象,在分析其农地流转的情况下,结合问卷调查法分析土地流转中农民权益状况,进而采取定性和定量结合方法对土地发展权配置进行分析。[结果]成都市农地一直处于流转状态; 同时通过问卷调查发现成都市439%的农户愿意流转自己的土地,而286%的农户无所谓, 275%的农户不愿意流转自己的土地,整体上说成都市农户对土地流转的意愿不是很强烈; 因此需要充分发挥土地发展权的行政配置和市场配置来管理规范其农地流转。[结论]土地发展权作为一种物权,在土地流转过程中引入土地发展权主要通过政府宏观调控及市场有效运营以巩固土地公有制、保障农地流转的公平合理及确保农户的土地权益。

AN EMPIRICAL STUDY ON ALLOCATION OF LAND DEVELOPMENT RIGHT IN RURAL LAND TRANSFER IN CHENGDU CITY

Abstract:
Agricultural land circulation is an inevitable result of urbanization development. The rational allocation of land development rights is conducive to realizing the greatest benefits of land circulation, and at the same time it provides some guidance for the land management system and the protection of farmers′ rights and interests in the process of land transfer.The article took Chengdu as the research object. Under the analysis of the circulation of agricultural land, the questionnaire survey method was used to analyze the status of farmers′ rights and interests in land circulation, and then qualitative and quantitative methods were used to analyze the allocation of land development rights.The results showed that Chengdu′s agricultural land had been in circulation; at the same time, a questionnaire survey found that 43.9% of farmers in Chengdu were willing to transfer their land, while 28.6% of farmers didnot care, and 27.5% of farmers were unwilling to transfer their land. Generally, farmers in Chengdu were not very willing to transfer their land. Therefore, it is necessary to give full play to the administrative allocation and market allocation of land development rights to manage and regulate the circulation of agricultural land. As a property right, the right to land development is introduced into the process of land transfer. The land development rights are mainly controlled by the government′s macro control and market operations to consolidate the public ownership of land, ensure the fairness and reasonableness of farmland circulation, and ensure farmers′ land rights and interests.
