| 摘要: |
| 文章通过对农村宅基地现状、存在问题进行分析，发现当前我国在宅基地制度立法方面已经相对完善，如宪法、物权法、土地管理法和国务院及相关部委发布、下达的若干规定与意见都对宅基地相关问题进行了规定，以切实保证农民利益。但同时也发现存在着布局散；多数村庄无用地规划，有规划的一般都起点高、标准高，不符合实际情况现象严重；一户拥有多处住宅现象普遍存在，宅基地私下交易市场活跃的使用现状。宅基地存在问题主要包括宅基地闲置多、宅基地浪费大、所有权形同虚设、使用人群变化大、功能变化大、存在买卖行为、对违法宅基地的拆除措施难以落实等问题。国家高度重视农村宅基地改革，通过近几年的努力实施，也收到了一定的成效，主要表现在使用权登记的有序推进，截止2014年7月，我国在农村宅基地使用权发证率达到80%。同时流转试点也初见成效，如浙江、四川、江西部分县市宅基地流转试点均较为成功。 |

| Through the analysis of the current situation and problems of rural land，we found that in order to ensure the interests of farmers，the current legislation on the homestead system has been relatively perfect，such as the constitution，property law，land management law and the State Council and relevant ministries that has issued a number of provisions and comments on the relevant issues of the homestead Also there were some problems about the desultoriness layout and most of the villages useless planning.The villages useless planning is that the plan began with a high starting point and a high standard，it was serious that the phenomenon did not meet the actual situation；a family has many residential phenomenon that was so widespread，the use of private housing market actively consisted.Homestead problems including idle houses，residential waste，useless ownership，change people，change function，trading behavior，to the dismantling of the homestead law measures to implement problem.For various problems in the use process，the state attached great importance to rural homestead reform，through the implementation of the past few years，it has received some results，the main performance in the orderly use of the right to register，by the end of July 2014，the rural homestead use right certification rate of China has reached 80%，and the initial success of the circulation pilot，such as Sichuan，Zhejiang part of the pilot has been more successful. |
