目前我国城乡建设用地增减挂钩中土地增值收益形成过程与数量模糊不清,农民在城乡建设用地增减挂钩政策实施过程中的土地权益尚未得到有效保障。文章从土地发展权视角出发,综合考虑城乡建设用地增减挂钩中拆旧区与建新区土地增值收益形成过程,从土地自然增值与人工增值等方面构建了城乡建设用地增减挂钩中土地增值收益测算模型,确定了增减挂钩中拆旧区与建新区土地增值收益测算方法,并选择辽宁省典型项目区作为样本进行实证分析。研究结果表明:基于土地发展权理论构建的城乡建设用地增减挂钩土地增值收益测算模型与方法测算结果均有土地增值收益存在,且当建新区用途为商住业用地时形成的土地增值收益高于建新区为工业用地时形成的土地增值收益;测算在增减挂钩中形成的土地增值收益一般在600元/m2左右。在此基础上提出政策性建议,指出应建立科学的公众参与机制与农民利益保障监督机制,充分尊重农民意愿,从而保障农民权益。 |

At present,during the implement of the linkage of the increase of city construction land and the decrease of rural residential,the formation process and the number of land value increment are blurryThe farmer's rights and interests are not guaranteed in carrying out this policyIn this study,from the perspective of land development right,the formation of land value increment in the new built area and the disassembled old area were consideredThe benefit calculation model was constructed from two aspects,ie.,artificial increment and unearned incrementThe measuring and calculating method was applied to calculate the land value increment,taking the typical area of Liaoning province as an exampleThe result showed that there was a land increment income in the linkage of the increase of city construction land and the decrease of rural residential based on the theory of land development rightThe land increment income was higher when the new built area was used for commercial and residential than that used for industryThe land increment income was measured 600 yuan per square meter.Finally,it suggested that it should establish a scientific mechanism for public participation and monitoring to protect the interests of farmers,and respect the wish of farmers. |
