[目的]随着市场经济的发展,城市化进程的加快,我国人地矛盾日渐尖锐,耕地保护也面临着巨大的压力,基于以上背景,国家越来越重视农村集体建设用地的流转,这不仅关系到我国土地基本国策的落实和国民经济的可持续发展问题,还关系到农民、农业、农村的稳定与繁荣。[方法]因此基于对现有文献的借鉴和总结的基础上,重点从利益相关者的角度出发,从正、负面相关机制对其流转有关的动力因素进行深入分析,具体运用归纳法、案例分析法,简要阐明农村集体建设用地流转形式、相关政策等流转现状,详细分析农村集体建设用地流转相关动因和存在的问题,特别是在流转过程中涉及相关主体的利益问题。[结果]得出只有充分了解农村集体建设用地流转的动力机制,其中不仅包括政策的刺激、周边环境的影响、经济利益的诱导等正面促进因素,还包括产权的不清晰和收益分配不合理等阻碍因素。[结论]并从各个主体的利益出发,保障他们的相关权益,达到主体间利益的均衡才能促使流转有序顺利地进行,最后给出相关建议。 |

With the development of the market economy and the accelerating of urbanization, the contradictions between people and land are becoming increasingly acute, and hence the arable land protection was in great pressure. Based on the above backgrounds and reasons, China has paid increasing attention to the rural collective construction land circulation, which was related to not only the basic national policy and the sustainable development of the national economy, but also the stability and prosperity in farmers, rural areas and agriculture. Therefore, based on the existing literatures, this paper from the perspective of interest correlation deeply analyzed the circulation of related dynamic factors from the pros and cons′ mechanism, briefly revealed the present situation of the rural collective construction land circulation including primary forms, relevant policies, etc. And it examined the problems and reasons in the process of circulation from the all the participants′ views. The results showed that only understanding the dynamic mechanism of rural collective construction land circulation it would make the land circulation much smoothly. The mechanism included the positive factors such as the stimulation of the external policy, the influence of the surroundings and the induced by economic interests, but also the negative factors such as the unclearly defined property rights, unreasonable profit collocation and so on. Finally, it raised some suggestions for the land circulation. |
