焦作市农地流转中的土地发展权配置研究

摘要:

农地流转是优化土地资源配置，实现农业规模化经营发展，转移农村劳动力的主要途径，同时也是促进农村经济发展的主要手段。文章主要针对河南省焦作市现阶段农地流转中土地发展权合理配置进行简要实证分析，在阐述农地流转发展现状的基础上探讨焦作市农地流转中土地发展权配置问题及主要流转形式，通过调查等方式发现目前焦作市农地流转中土地发展权配置存在较大问题，如土地发展权主体不明确，缺乏法律体系保护、土地流转行为操作不规范、土地使用权主体间产权关系不清楚、缺乏土地产权价格体系等，并针对焦作市农地流转中的土地发展权配置问题提出完善法律制度，明确流转土地发展权收益； 健全土地流转管理机制，保障农民土地发展权； 以总量、结构、区域、时序配置实现土地发展权配置公平性等建议，以促进焦作市农地流转公平、公正地开展，为今后焦作市农地发展提供理论参考。

Abstract:

As the main mean to promote the development of rural economy, rural land transfer is the main way to optimize the allocation of land resources, realize the development of agricultural scale management, and transfer the rural labor force.The article analyzed the status quo of rural land circulation development, discussed land development rights allocation problems inthe land transferin Jiaozuo city through the investigation methods, which mainly included the unclear subject of the land development right, the lack of legal system protection, the unstandardized operation of the land transfer behavior, and the lack of land property price system. Finally, some suggestions were put forward to promote the development of land in Jiaozuo, including perfecting the legal system to clearthe transfer rights,improving the management mechanism, and protecting farmers′ land development rights through the fair configuration of quantity, structure, region, and timing,etc.We hope this can provide a theoretical reference for the future development of agricultural land in Jiaozuo city.
