农村土地承包经营权抵押风险评估与防控研究

摘要:

［目的］构建风险评估指标体系，综合评估新疆昌吉回族自治州呼图壁县和玛纳斯县8个村的土地承包经营权抵押的潜在风险，从政府视角下提出构建农村土地承包经营权抵押风险防控体系，寻求政府、银行、农户三方主体的平衡关系。［方法］利用SPSS190软件，采用因子分析法，建立风险评估模型，计算出样本区各调查村的风险得分值与等级。［结果］样本区农户土地承包经营权抵押风险较大，三方主体出现“一头凉”“两头热”的现象； 基于不同主体对土地承包经营权抵押贷款政策的顾虑，土地承包经营权抵押贷款政策全面推广难度大， 存在着一定的潜在风险。［结论］依据风险影响要因的分析结果，提出相应的规避风险建议，政府应当充分发挥“大管家”的作用，管控三方主体风险程度，防范农村土地承包经营权抵押风险，以保障各方利益主体合法权益为最终目的。

Abstract:

This paper constructed the risk assessment index system and comprehensively evaluate the potential risks of land contract management right in eight counties of Hutubi and Manasi county, Xinjiang Changji Hui Autonomous Prefecture, and put forward the construction of rural land contract management right from the government perspective mortgage risk prevention and control system, to seek the government, banks, farmers tripartite balance of the main body. Using SPSS19.0 software, factor analysis method was used to establish the risk assessment model, and the risk score and grade of each survey village were calculated. The results showed that the risk of land contractual management right of farmers in the sample area was big, and the main body of the three parties had a "cool" and "hot" phenomenon. Based on the concern of the different main parties on the land contractual management right mortgage policy, the land contractual management right mortgage policy promotion was difficult, which was in a certain potential risk. According to the analysis result of the risk influence, it put forward the corresponding risk prevention proposal, including giving full play to the role of "big housekeeper", controlling the degree of risk of the three parties, and guarding against the risk of collateralization of rural land contract management right legal rights and interests.
